Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Right Back ("RightBack", "we", "us") governing your use of the RightBack app and services (the "Service"). By downloading or using RightBack, you agree to these Terms. If you do not agree, do not use the Service.

RightBack creates a synthetic, AI-generated simulation of a voice. It is not the real person and cannot replace them. It may say things that are inaccurate or that the person never said. Please use it as a keepsake, not as a source of facts, advice, or decisions.

1. Who can use RightBack

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract to use the Service.

2. Your voice content and permitted use

Before creating a voice, you must confirm — and you represent and warrant — that:

• you have the right to use the recordings you provide;
• you have permission to recreate that person's voice, or are otherwise legally entitled to do so;
• the person is not a public figure being impersonated, and is not someone who has refused or is unable to consent in a way that makes recreating their voice unlawful.

You agree not to use RightBack to impersonate anyone for fraud or deception, to harass, defame, or harm anyone, to create misleading or unlawful content, or to violate anyone's rights or any applicable law. You are solely responsible for the content you provide and how you use the voices you create. We may suspend or remove content or access that we reasonably believe violates these Terms.

3. Subscriptions, billing, and cancellation

RightBack offers auto-renewable subscriptions purchased through your Apple ID:

• Yearly plan — US$49.99 per year (shown in-app as approximately US$0.96 per week).
• Weekly plan — US$3.99 per week.

A subscription includes up to 2 hours (7,200 seconds) of conversation per month in the recreated voice; this allowance resets at the start of each month. A short free conversation is available before subscribing. Prices are shown in your local currency at purchase and may vary by region and over time.

Payment is charged to your Apple ID at confirmation of purchase. Auto-renewal: the subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period; your Apple ID is charged for renewal within 24 hours before the period ends. Managing and canceling: you can manage or cancel your subscription anytime in your device's App Store settings. Deleting the app does not cancel a subscription. Refunds for purchases made through Apple are handled by Apple under the App Store terms; we do not process refunds directly.

4. AI-generated content disclaimer

The voices and conversations are generated by artificial intelligence using third-party technology. They are simulations and may be inaccurate, incomplete, or unexpected. RightBack is intended for personal, emotional, and remembrance purposes only. It is not a medical, psychological, legal, financial, or emergency service and must not be relied upon for any such purpose. If you are struggling, please reach out to a qualified professional or a support line in your area.

5. Third-party services

RightBack relies on third-party providers (including ElevenLabs, LiveKit, Cloudflare, and Apple) to function. Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for third-party services we do not control. See our Privacy Policy for how data is shared with them.

6. Intellectual property

The Service, including its software, design, and branding, is owned by RightBack and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial use, subject to these Terms. You retain your rights in the content you provide.

7. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that a generated voice will resemble the person. To the maximum extent permitted by law, RightBack and its suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, arising from your use of the Service; and our total liability will not exceed the amount you paid us in the 12 months before the claim.

8. Indemnification

You agree to indemnify and hold harmless RightBack from any claims, damages, or costs arising out of your content, your use of the Service, or your breach of these Terms — including any claim that a voice you created infringed someone's rights or was created without proper permission.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service unlawfully. Sections that by their nature should survive termination (including 2, 4, 6, 7, 8, and 10) will survive.

10. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, and disputes will be handled by the competent courts of the State of Delaware, United States, unless mandatory local consumer law provides otherwise.

11. Apple App Store terms

These Terms are between you and RightBack only, not with Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims relating to the app (product liability, legal or regulatory non-conformance, or consumer protection claims) are our responsibility, not Apple's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, notifying you in the app. Continued use after changes take effect means you accept the updated Terms.
